APPEAL BY THE COMMITTEE “SALIDARNASC” TO HEADS OF PENITENTIAL INSTITUTIONS

18 letters of appeal with Concluding Observations of the UN Committee against Torture were submitted by the Committee “Salidarnasc” to administrations of correctional facilities and pre-trial detention facilities of the KGB and on Valadarskaha str.   “International obligations of the Republic of Belarus are a priority over the national legislation and shall be implemented no matter what the political situation is and despite any other circumstances” – Inna Kuley, Chairperson of the Committee “Salidarnasc”, mentions in the appeal letters she signed.   Чытаць далей

STATEMENT BY THE BELARUSIAN BOLOGNA COMMITTEE

System of higher education in Belarus has become a tool for political repressions against dissidents, as mentioned in the Statement.   
We ascertain that systemic violations of human rights in Belarusian institutions of higher education anchor authoritarian rule inside the higher school, thus demonstrating the fact that heads of educational institutions fail to understand fundamental academic values: university autonomy and academic freedom.
  Setting such values at defiance does not allow current system of Belarusian higher education to join the Bologna Process and become a full-fledged member of the European Higher Education Area (EHEA).   There is a direct connection between the “black list” and the denial by EHEA.   Чытаць далей

“SALIDARNASC” DEFENDS STUDENTS

In connection with the fact that three students were expelled from Minsk State Linguistic University, Committee “Salidarnasc” sent out letters of reaction and pressure to Natallia Baranava, rector of MSLU, so that to “clear out the situation, to objectively assess cause of events and give the expelled students a chance to continue their education.”   Committee “Salidarnasc” mentioned in the letter that there are grounds to talk about political motivation in decisions about expulsion of Aliaksandr Saldatsenka, Aliaksandr Vialitchanka and Mikita Kavalenka from MSLU. Released From Prison Hospital

The following day Dzmitry Uss, former presedential candidate was released, state media reported that "Lukashenka pardoned some of the prisoners convicted for the "street riots" in Minsk on December 19, 2010.

Dzmitry Uss released October 1 from prison hospital, when he was recently held.

Recall, Dzmitry Uss has been detained on the night after presedential elections. Was kept in KGB jail for the day and then released. Charged under article 293.

Uss mother: "I'm worried about son's state of health"

Ex-candidate on the presedential elections, political prisoner Dzmitry Uss’s been transferred to the medical center in the detention center on Valadarsky street in Minsk. As the result of the medical commission there, prisoners disability group has changed from third to second, as the wife of former candidate for presidency said.

Uss was taken to the magnetic resonans tomography accompanied by the head doctor of the prison and its governor. The prisoner must be examined by high-level expert the other day.   Uss lawyer sent a demand to find out the true state of health of his client and give his relatives the answer, if he is needed in immediate and serious treatment. Prisoners mother managed to get a 30-minute meeting with her son. Dzmitry Uss looks very thin and tired, according to her.

35th Anniversary Of The Moscow Helsinki’s Group

Famous human rights defenders from Belarus, Poland, Russia, Ukraine, Moldova, Georgia, Turkmenistan and many others came to Moscow to participate in the International Forum of Human Rights Defenders in Eurasia dedicated to the 35th anniversary of the Moscow Helsinki’s group work. The Forum took place from 11 to 13 May. A lawyer of the Committee for Defense of the Repressed “Solidarity” also participated in the Forum.

Political Prisoners Released On The Day of Belarusian Solidarity

On May 16, on the day of Belarusian Solidarity, family, friends and colleagues met with the political prisoners released from custody at the court room after the announcement of the verdict. Iryna Halip got two years term with a two- year suspension, Paval Sevyarynets – three years of work release, Syarhei Martsaleu – two years with a two-year suspension.

Yauhen Skrabutan submitted a letter to the Minister of Education

Yauhen Skrabutan, a Kalinouski program grantee, submitted a letter to the Minister of Education, in response to Machkevich’s media statements that students are not expelled on political grounds in Belarus. Yauhen Skrabutan reminded the official about the story of his expulsion.

Tankachova: "Unmotivated decisions"

After five severe verdicts announced to the Ploscha participants, Alena Tankachova said to Radio Liberty that before the trial the materials of the international investigation on December 19 events were released. The reporters arrived to the conclusion that there were no mass disturbances in Minsk.

“Each time we are waiting for a change from a repressive trend. To some extent we were sure that the conclusions of the experts’ report and a detailed investigation of the evidence will result in the court refusing from the article on “mass disorders.” Unfortunately, the verdict we heard today continues the previous strategy. The sentence is very severe and disproportionate to the offence. These verdicts will sooner or later be reconsidered. Each time it is so sad and painful to see how unmotivated decisions are made and behind them are people’s lives.”

Press for political prisoners

Every month “Solidarity” volunteers secure media subscriptions for political prisoners. Among the newspapers and magazines are “Narodnaya Volya”, “Nasha Niva”, “Belgazeta”, “Komsolskaya Pravda”, “Pressball” and others according to the prisoners’ preferences. The newspapers are delivered to the cell that helps to stay informed about all events, be aware of developments and not to be detached from the life outside of prison, as the Volodarsky detention center prisoners writes. The convicts who have been transferred to the colonies receive mass media to their new addresses.

Students Expelled for Political Reasons Invited to Continue Education in Estonia

Estonian Ministry of Foreign Affairs provides scholarships to Belarusian students for 2011/2012 to study at Eurocollege of the University of Tartu. The University of Tartu is the oldest university of the region that was founded in 1632 by the Swedish king Gustavus Adolphus. The University will cover one year tuition, travel costs to/from Tartu, insurance and accommodation, as well as provide visa support to students. Students from Belarus are encouraged to apply by the end of April submitting the following documents:

“Salidarnasc” – Five years together

The Committee for Defense of the Repressed “Salidarnasc” was founded five years ago on the wave of expulsions from universities and layoffs of those most active in Alyaksandar Milinkevich’s and Alyaksandar Kazulin’s electoral campaigns. Unfortunately, today the Committee’s work is still relevant and needed. For five years the staff of “Salidarnasc” has been providing all possible help to people who face various political persecutions in Belarus. Hundreds of people turned for help to the Committee. They came for legal assistance, those who suffered from illegal actions by police and its special units sometimes required medical help, moral, psychological and other. Among the most successful programs by the Committee is Kastus Kalinouski’s educational program at Polish universities that targets the repressed Belarusian students.

Political Trials Continued in Minsk

These hot April days the whole city of Minsk turned into a courtroom, where the trial is held against political opponents of the existing regime. There hardly has been enough time for the panic in convenience stores to settle down, or for the echo of the horrible terrorist act in the Minsk metro to pass. A common man cannot possibly understand from the state mass media what kind of “terrorists” and “hooligans” are on trial and how investigation of such a complex case could have been carried out in such short time. As it turns out, the official mass media label as “the terrorists” the participants of the protest action against rigged elections that took place on December 19, 2010.

Dangerous Jurisprudence

There is a slim chance for justice when Belarusians go to court, especially if its decision may affect the interests of the state or some government officials.
Timothy Atroshchankau  appealed
to the Court of Moscow district of Minsk with a claim for financial compensation for moral harm after serving an administrative penalty in the detention center in Minsk. Parents of political prisoners gathered together

The meeting with parents of young people accused in case of “riots” in Minsk on Dec. 19, 2010 took place in “Solidarity” committee. -The latest political criminal proceedings that took place in Belarus, have shown that there is no evidence of riots, that people are accused in - Valentin Stefanovich, lawyer, human rights activist said during the meeting. Occurred trials on Parfiankou, Atroshchankau, Malchanau, Novik, Breus, Haponau, Medved and Likhavid have shown violation of the Criminal Procedure Code, as the investigation is not completed, and the courts have already started their work. Kalinouski program 2011-2012 has started

Polish Goverment has decided to organize a special extra set of Kalinouski program, after the “Solidarity” Commitee send its request for helping  the students who took an active role in presedential elections and were under the threat of criminal prosecution. 59 young Belarusians were invited to Poland for getting the opportunity to participate in preparatory courses of Polish language and culture, that will run until September 2011. After completing coursework, students will be sent to study in Polish universities. In March fellows were gathered in Warsaw for the impressionable cultural program: excursions, lectures, visits to key institutions of Poland. After that some of them will stay in Warsaw, while others will go to Krakow and Wroclaw to start learning Polish. Чытаць далей

Andrei Klimau has spent week in remand prison

On April 3 an opposition leader Andrei Klimau was arrested in Minsk. For publishing on the web and article the politician in charged with violation article 361 Part 3 of the Criminal Code of Belarus (appeals to overthrow or change of he constitutional regime of Belarus committed with the use of mass media). At the moment Andrei Klimau stays in the remand prison in Valadarski Street in Minsk. He faces a sentence from 1 to 5 years of imprisonment.

The investigator of Minsk prosecutor’s office Anatol Hadun, who is investigating the case of Andrei Klimau, denies comments to journalists. Nothing is informed about conditions of detention of Andrei Klimau in Minks remand prison.

Stop discrimination in Belarusian universities

Minsk Moscow district court has not satisfied the claim of the former student of Political Science department of Law Faculty of BSU Tatyana Shaputska to the Ministry of Education and BSU. Tatiana was expelled immediately after she had been invited to participate in the Civil Society Forum \Eastern Partnership\ 16-18 November 2009 in Brussels, and because of this missed 3 days of classes. “Honestly, I was hoping that Judge Yuri Shestakov would show more interest in the process”, says Tatiana. “He almost did not get into disputes of the parties and did not ask any questions. It seemed that he knew what decision to make the next day and that is why didn’t see any sense in taking part in the process”.

Statement on Aleh Surhan's sentence

Committee for Defence of the Repressed “Salidarnasc” is very concerned by the sentence to Aleh Surhan. On the 19th of February Aleh Surhan was sentenced by Vitebsk Kastrychnicki district court to 6 months of arrest and 2,5 millions Belarusian rubbles of compensation under the article 364 of Criminal Code of the Republic of Belarus (violence or the threat of using the violence against militiaman or his relatives). Aleh Surhan was detained while he was hanging white-red-white flag. When he was being driven to militia department he was beaten by militiamen. In militia department he wrote a complaint to the prosecutor’s office and right after this militiaman Siarhei Dudkevich said that he was attacked by Surhan. Criminal case was brought against Surhan. The only witnesses at trial were militiamen. Dudkevich said during the trial that Surhan had bitten his finger when he was not letting Surhan “to hit his head against militia car”.

Political Draft in Belarus

There are four main types of getting rid of “undesirable” persons in non-democratic society: assassination, prison, mental hospital and army. Only two first types were used in Belarus in the past decades now political draft is becoming a very popular form of repression in the country. For the first time it happened after the presidential elections in 2006 when during the summer draft several activists were sent to the army. It is well-known that there were numerous facts of breaking the law during the draft, including pressure on doctors by the members of special services. At the same time there were opposite cases, such as with the activist of BNF Youth Aliaksei Trubkin, who wanted to serve in the army but the authorities refused to draft him though he had no medical contraindications.

Monitoring of the situation with human rights in regions of Belarus in January-June 2009

This monitoring is prepared on the basis of tracking the situations and the development of events in the country after the beginning of dialogue between EU and Belarus. In this document we mention negative and positive fact that took place in the regions of Belarus in the period from the 1st of January till the 1st of July 2009.
Main results:

• The situation in the whole in the regions is being tense and there are no signs of real changes
• The reduce of amount of repressions by the authorities can be explained not by the liberalization of the treatment of the opposition by the authorities but by the absence of any significant social and political events in the given period.
• The repressions are mainly of the hidden character. The most typical example is firing from job. This hidden character is explained by the fact that firing was done as if for legal reasons, but there were always political motivation in such cases. The same is the situation with employment;

The Trial over Maksim Dashuk

The trial over Maksim Dashuk, activist of youth organization European Belarus is scheduled at 2.15 p.m., June, 1st 2008, in the Maskouski district court of Minsk (Gazety Praudy 27).
Youth activist Maksim Dashuk (under age) was charged with violations of the rules of serving punishment. This is article 415 of the Criminal Code, according to which Dashuk M. can face from six months to three years in prison.
Maksim Dashuk was presented accusation on 23 February. Dashuk received some warnings for violation of the rules of serving home arrest.
The activist said about the reasons for his arrest: ‘I got all warnings for I was out when I must have been at home. I was allowed to leave the flat only two hours a day, but I had to help my mother, as my father died in April. I didn’t have a job, I am minor, and I’m not registered in Minsk.’
